Virtual Try-On (VTO) Consent Form

Please read before activating your camera. This form explains how Illusion Eyewear's Virtual Try-On feature works and asks for your consent before your camera is used. This consent is designed to meet the requirements of Illinois, Texas, and Washington's dedicated biometric privacy statutes, and the biometric and sensitive-data consent requirements of every other U.S. state with a comprehensive privacy law, so that a single consent applies consistently regardless of where you live.
1. What Virtual Try-On Does
Virtual Try-On (“VTO”) uses your device's camera to show a live preview of eyewear on your face. When you activate VTO:
- Your camera feed is processed in real time, entirely on your own device, inside your browser;
- Temporary facial reference points (“biometric information” under most state laws — for example, positions used to size and place the eyewear preview) are generated for this purpose only;
- Your camera feed and this facial reference data are never recorded, uploaded, or transmitted to Illusion Eyewear, Shopify, or any third party;
- Nothing is stored anywhere — all of this data is automatically and permanently discarded the moment you close the VTO window, refresh the page, or end your session;
- This data is used solely to position an eyewear preview on your face. It is not used for identification, advertising, analytics, or any other purpose, and it is never sold or shared.
VTO is a visual preview only. It does not generate, and must not be relied upon for, a prescription, pupillary distance (PD), or any other physical measurement.
2. Retention and Destruction
Illusion Eyewear does not retain any biometric identifier or biometric information generated by VTO, on any system, at any time. Because this data is processed exclusively on your own device and never transmitted to us, there is no retention period and nothing for Illusion Eyewear to affirmatively destroy on its own systems — destruction occurs automatically, on your device, the moment your VTO session ends. This satisfies the written retention-and-destruction disclosure required under Illinois and Texas law, and the written biometric data policy required under Colorado law, by describing an architecture with no retention at all.
3. No Sale, No Sharing, No Advertising Use
Illusion Eyewear does not sell, rent, or share the biometric information generated by VTO with any third party, under any circumstance, and does not use it for advertising, profiling, or any purpose other than generating your eyewear preview. This satisfies the no-sale requirements of Maryland and other states that separately prohibit the sale of biometric data.
4. Accessibility of Virtual Try-On
Virtual Try-On shows a live visual preview, and there is no equivalent experience we can offer to a customer who is blind. We state this plainly rather than leave it unsaid. The feature is not hidden from screen readers: it remains reachable and is labelled so that you know what it is before activating it, and this consent notice can be read, operated, and declined using a keyboard or a screen reader alone.
If you cannot use Virtual Try-On, we provide the information you need another way. Every frame lists its lens width, bridge width, and temple length, together with a frame size from Extra Small to Extra Large, so you can compare against eyewear you already own. 5. Your Consent
By clicking “Allow Camera & Continue,” you consent to the one-time, on-device processing of your facial geometry described in this form, for the sole purpose of generating a Virtual Try-On preview. This consent is specific to VTO and is not combined with your acceptance of our Terms of Service, Privacy Policy, or any other agreement.
How consent is given. Consent is given by clicking “Allow Camera & Continue.” That click is the affirmative act required under Illinois, Texas, and Washington law; no separate checkbox is used, and no option is pre-selected. “Allow Camera & Continue” and “No Thanks” are presented with equal prominence, and the camera is not accessed unless “Allow Camera & Continue” is clicked. Both buttons are reachable and operable by keyboard, and the notice can be dismissed with the Escape key, which declines.
6. Withdrawing Consent
Because no data is retained after your session ends, there is nothing to delete after the fact — simply closing the VTO window or declining to use VTO again fully withdraws your participation. If you have questions about this Form, contact us at support@illusioneyewear.online.
7. Record of This Consent
Whenever the technical system supporting Virtual Try-On is built to automatically log consent (a timestamp and a non-biometric session identifier, never any biometric data itself), that recordkeeping should be described here. At present, no such automated system is in place, so no record of individual consent events is being generated or retained by Illusion Eyewear.
